OREANDA-NEWS. March 17, 2016. As discussed in our January 2016 bulletin “USCIS Proposed I-9 Changes – Seeks Public Input”, the current version of Form I-9 (OMB No. 1615-0047) is set to expire on March 31, 2016.  With the expiration now just a few short weeks away, many Employers are beginning to outline plans to ensure the proper Form I-9 will be used within their onboarding procedures.  The only problem is:  U.S. Citizenship and Immigration Services (USCIS) has been reviewing the public comments on the proposed I-9 changes and there is no formal guidance – yet.  A total of 133 comments were submitted by the public and based on reports, USCIS is in process of reviewing the comments for consideration before issuing guidance.

So what should you plan for at this point?  As the 3/31/16 expiration date looms, it is anticipated that an extension date will be released under the current Form I-9 format.  It will essentially be “business as usual” as long as the Form I-9 being used matches the then current form.  Beyond an anticipated short-term date extension, a new Form I-9 will likely be released later in the year containing some (if not all) of the proposed adjustments outlined in the January 2016 bulletin.

For clients using the I-9 Management solution from Equifax Workforce Solutions, any updates to Form I-9 will be applied to the system to coincide with Form I-9 extension dates and/or changes to the overall Form I-9.  Stay tuned to the Equifax Insights Blog for further information as these developments progress and the newest version of the Form I-9 comes to fruition.
