FBK at the IX All-Russia Tax Congress
In 2015 the key topics of one of the most authoritative in Russia annual summits on tax were such pressing issues as the application of the law on controlled foreign companies, transfer pricing, new rules of tax calculation and collection.
Ekaterina Dbar, FBK Legal senior lawyer, project manager of the tax consulting practice, and Natalia Yashchinskaya, FBK Valuation senior manager were invited to work in one of the sections — “Topical issues of tax planning and control”.
They spoke on the specifics of calculation and administration of property tax on the basis of cadastral value beginning from Y 2015.
Ekaterina Dbar explained to the session participants if you could challenge the inclusion of an object in the list of real estate taxable by cadastral value, and also about how the change of an object cadastral value should be reflected in the tax records. Natalia Yashchinskaya spoke about the practice of assessment of property for the purpose of contesting the cadastral value and about the procedures for changing the cadastral value.
“We summarized our experience and spoke about what we used to come across in practice; we gave examples from judicial practice, pointed to the factors that can significantly affect the size of tax burden. It is important for any business,” commented Ekaterina Dbar.
“It sometimes happens that the cadastral value of property differs significantly from its market value based on which the property tax is calculated. We explained the procedures that serve to determine and change the cadastral value, in particular, we described the procedure and the grounds to challenge the cadastral value, which often raise questions of our clients. We will be glad if our experience helps the representatives of different companies to optimize the tax burden,” added Natalia Yashchinskaya.
