Moscow OFAS Initiates Cases against Spetsstroi
OREANDA-NEWS. November 20, 2014. The Office of the Federal Antimonopoly Service in Moscow (Moscow OFAS Russia) initiated several cases against the “Industrial Enterprises Department at Spetsstroi Russia” Federal State Unitary Enterprise upon elements of violating the antimonopoly law in the part of the procedures for concluding contracts for leasing state property (Part 1 Article 17.1 of the Federal Law “On Protection of Competition”).
Earlier the Department concluded contracts for leasing its premises with the “Main Department for Highways and Aerodromes Construction” Federal State Unitary Enterprise and No.4 Road Construction Department” Federal State Unitary Enterprise. Under the Federal Law “On Protection of Competition” contracts for leasing state property can be concluded only upon outcomes of tenders, except when a contract is concluded for no longer than 30 days within six consecutive months. It is prohibited, however, to prolong contracts without tenders.
According to Moscow OFAS Russia, the Department concluded short-term lease contracts and then repeatedly prolonged them, increasing the leased premises.
The cases are scheduled on 9 December 2014.
