OREANDA-NEWS. September 16, 2014. The FAS Commission found that the “Central Commandant’s Office on Logistic Assistance of the General Headquarters of Internal Ministry Troops” Federal Treasury Enterprise violated Clause 2 Part 1 Article 17 of the Federal Law “On Protection of Competition” by creating preferential conditions for to particular companies taking part in tenders and quotation requests.

The FAS Commission also established the fact of concluding and implementing an oral agreement between “Global Stroi” Ltd., “Monolit” Ltd. and “Vozrozhdenie” Construction Company” Ltd. that resulted in maintaining prices in the course of competitive bidding, which constituted a violation of Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”. The total contracts concluded with the violators exceeded 240 million RUB.

The FAS Commission decided to transfer the case file to the law enforcement bodies to initiate a criminal case against officials of “Global Stroi” Ltd., “Monolit” Ltd., “Vozrozhdenie” Construction Company” Ltd. upon corpus delicti under Clauses “a”, “b” Part 2 Article 178 of the Criminal Code of the Russian Federation.

“Positive judicial practice is establishing to hold cartel participants criminally liable. Hopefully, the decision of FAS Commission will form the basis of a criminal case”, said the Head of FAS Anti-Cartel Department, Andrey Tenischev.
