Rosimuschestvo Restricted Number of Bidders
OREANDA-NEWS. September 10, 2014. FAS found that omissions by Rosimuschestvo violated the antimonopoly law.
The Federal Antimonopoly Service (FAS Russia) found that the Federal Agency for State Property Management (Rosimuschestvo) violated Part 1 Article 17 of the Federal Law “On Protection of Competition”.
In the course of the case investigation, FAS established that in the period and after selling debtor’s property had been suspended on the basis of an order of a court bailiff, Rosimuschestvo failed to undertake measures to accept bids from persons who directly intended to take part in the auction, which considerably restricted the number of bidders.
Accepting the bids was suspended just for the period when, according to the auction notice, it was possible to file the bids. As a result a number of bidders were not allowed to take part in the auction.
“An order of a court bailiff to suspend selling debtor’s property should not constitute the grounds to suspend and refuse to accept bids since sale of property by itself takes place only at the time of an auction”, commented the Head of FAS Department for Control over Housing & Utilities Sector, Construction and Natural Resources, Vadim Solovyov.
