Russian Railways Executed Warning of Saratov OFAS
OREANDA-NEWS. August 21, 2014. “Russian Railways” OJSC executed a warning of Saratov OFAS Russia to stop actions that have signs of violating the antimonopoly law. On 1st August 2014 the antimonopoly authority was notified by the company that the determination had been executed.
Earlier the Office of the Federal Antimonopoly Service in the Saratov region (Saratov OFAS Russia) received a complaint from “Mikom” Construction Company” Ltd. about actions of “Russian Railways” OJSC.
“Mikom” had a plan to construct private tracks, particularly, on a plot of land that is a federal property and is used by “Russian Railways” OJSC on a leasehold basis. Therefore, without a sub-lease contract with the railway company, “Mikom” Ltd. did not have legal grounds to start the works. “Russian Railways” OJSC were prepared to conclude the contract only if along with the works planned under the project the construction company would carry out additional repair works on public tracks.
Saratov OFAS Russia established that “Russian Railways” OJSC unreasonably refused to sign a sub-lease contract, therefore, restricting the right of “Mikom” Ltd. for constructing private rail tracks, and issued a warning to the monopoly to terminate actions that have elements of violating the Federal Law “On Protection of Competition”.
Executing the warning of Saratov OFAS Russia, “Russian Railways” OJSC concluded a mutually beneficial sub-lease contract with “Mikom” Construction Company” Ltd. and excluded controversial clauses from the technical terms and conditions.
