OREANDA-NEWS. July 15, 2014. The Federal Antimonopoly Service (FAS Russia) held “MRSK North-West” OJSC administratively liable and fined the company over 93 million RUB.

The Antimonopoly Service received a complaint from “Mezhregionenergosbyt” OJSC that “MRSK North-West” OJSC avoided coordinating capacity volumes contracted by the company for 2012.

FAS established that as a result of the network company refusing to apply in calculations the capacity contracted for 2012 and applying the maximum capacity contracted for 2011, “Mezhregionenergosbyt” OJSC could have incurred losses for over 31 million RUB. Thus, “MRSK North-West” OJSC insisted on concluding a contract under the conditions of exceeding the capacity contracted by “Mazhregionenergosbyt” OJSC for 2012.

Such actions of “MRSK North-West” OJSC were qualified as imposing disadvantageous contract conditions for electric power transmission services in the part of establishing additional consumption of contracted capacity (in breach of Clause 3 Part 1 Article 10 the Federal Law “On Protection of Competition”).

Moscow Arbitration Court confirmed legitimacy of the FAS decision. The company was imposed an administrative fine over 93 million RUB.
