Dagestan OFAS Initiates Case against Dagnefteproduct
OREANDA-NEWS. April 24, 2014. The Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan OFAS Russia) initiated a case against “Dagnefteproduct” OJSC upon elements of violating the antimonopoly law: economically or technologically unjustified avoidance of concluding a contract with “Azaca Invest&Finance Corp” for oil products shipping.

Part 1 Article 10 of No.135-FZ Federal Law “On Protection of Competition” prohibits economic entities with the dominant position to exercise actions that lead or can lead to preventing, restricting, eliminating competition and (or) infringing the interests of other persons, including economically or technologically unjustified refusals or avoidance of contracts with particular buyers (customers) if there is possibility to produce or supply goods and if such a refusal or avoidance are not directly provided for by the federal laws, normative legal acts of the President of the Russian Federation, normative legal acts of the Government of the Russian Federation, normative legal acts of the authorized federal executive bodies or judicial acts (Clause 5).
