Moldova Simplifies Process of Voluntary Liquidation of Companies
OREANDA-NEWS. April 22, 2014. According to the approved amendments to existing legislation, the deadline for submission of claims from 6 to 2 months from the date of publication of the notice in the "Monitorul Oficial", or from the date of notification about the liquidation of the enterprise.
It is envisaged to reduce the term asset allocation from 12 to 6 months from the date of publication of the notice, and from 2 to 1 month from the date of approval of the liquidation balance sheet. In addition, the amendments specify the conditions for the dissolution of the legal entity and the powers of the administrator/liquidator-clarify procedures in respect of the liquidation balance sheet, the term asset allocation and execution of claims of creditors, simplifying the procedure of notarization of legal acts.
Earlier the Vice-Premier, Minister of economy Valeriu Lazar stressed that, under current law, to establish and register a company in Moldova can be a maximum period of 5 days, at that time, as its elimination may be delayed for 12 months due to various bureaucratic delays.
The head of the Ministry of economy noted that the amendments proposed to solve reduce the timing of the procedures in case of voluntary liquidation of companies. At the same time, provide representation of sufficient time to protect the interests of creditors.
