OREANDA-NEWS. April 17, 2014. The Federal Antimonopoly Service (FAS Russia) established that the Department of State Highway Control in the Kaliningrad region, of the Federal Service for Transport Supervision (Rostransnadzor) violated the antimonopoly law by assigning the function of testing telematic subscriber terminals to “Vympel-Communications” OJSC.

Telematic subscriber terminal is a hardware-software device designed to determine the current location and traffic flow parameters and interact with the automated control centre of the Federal Service for Transport Supervision.

FAS investigated an antimonopoly case against the Department of State Highway Control in the Kaliningrad region, of the Federal Service for Transport Supervision upon elements of violating Part 3 Article 15 of the Federal Law “On Protection of Competition”.

In the course of the investigation, the FAS Commission established that in the Kaliningrad region “Vympel-Communications” OJSC had been testing telematic subscriber terminals, installed on the vehicles, including M category vehicles used for commercial transportation of passengers and N category vehicles used to transport hazardous goods.

At the same time, under No. 20 Order of the Ministry of Transport of the Russian Federation “On Approving the Procedures for Equipping Vehicles in Operation, Including Special Vehicles, M Category Vehicles Used for Commercial Transportation of Passengers and N Category Vehicles Used to Transport Hazardous Goods, with GLONASS or GLONASS /GPS Satellite Navigation Terminals”, the function for testing telematic subscriber terminals is assigned to the regional Departments of Rostransnadzor.

Thus, the Department violated Part 3 Article 15 of the Federal Law “On Protection of Competition”, which prohibits assigning the functions and the rights of the government agencies to economic entities.
