OREANDA-NEWS. April 16, 2014. The Office of the Federal Antimonopoly Service in the Republic Dagestan (Dagestan OFAS Russia) fined “Dagenergoset” OJSC over 29 million RUB for abusing market dominance.

Earlier “RTRS” Federal State Unitary Enterprise complained to the Antimonopoly Service that “Dagenergoset” OJSC failed to exercise all measures for technological connection to electric power networks within the designated period upon applications filed by “RTRS”.

OFAS initiated a case against the company and found that “Dagenergoset” OJSC violated the antimonopoly law. The proceedings, however, were terminated, as the company had voluntarily eliminated violations of the antimonopoly law.

At the same time, OFAS initiated an administrative case, since the fact of abusing market dominance had been established, and, consequently, there was a valid cause for the event of violation in the actions of the energy supplier.

Upon investigating the administrative case, OFAS fined the company over 29 million RUB.

“Voluntary elimination of a violation does not relieve a person from administrative liability; it is only a mitigating circumstance. Therefore, before violating the antimonopoly law holders of natural monopolies should remember large fines, which they shall have to pay for the violations”, pointed out Deputy Head of Dagestan OFAS Russia, Kurban Kubasaev.
