OREANDA-NEWS. April 15, 2014. The Office of the Federal Antimonopoly Service in St Petersburg (St Petersburg OFAS Russia) imposed a fine “Lyubavushka Retail Group” Ltd. (“Polushka” Trade Network). (Polushka means a quarter-copeck piece).

Earlier the FAS Commission established that the trading network failed to provide to a food products supplier - “Altai Krupa” Trading House” Ltd. access to information about the conditions of selecting counteragents for concluding a food supply contract. The trade network also did not have unambiguously ascertained rules for selecting suppliers, and the existing system of selecting counteragents restricted access of suppliers from other regions of Russia to “Polushka” Trade Network.

Thus, “Lyubavushka Retail Group” Ltd. created discriminatory conditions for “Altai Krupa” Trading House” Ltd. and prevented the company’s entry to the market of food products trading in St Petersburg. OFAS established that “Lyubavushka Retail Group” Ltd. violated Clause 1 Part 1 Article 13 of the Federal Law “On Trade”.

The trade network is fined two million RUB for committing the violation.

Clause 1 Part 1 Article 13 of the Federal Law “On Trade” prohibits trade networks to create discriminatory conditions, particularly, prevent entry of other economic entities to the market.

Under Part 1 Article 14.40 of the Code of the Russian Federation on Administrative Violations, creating discriminatory conditions by a trade network, particularly, preventing market entry is punishable by an administrative fine upon a legal entity from 2 to 5 million RUB.
