OREANDA-NEWS. April 14, 2014. The Federal Antimonopoly Service (FAS Russia) initiated a case upon elements of violating the antimonopoly law against “Severo-Zapad” Federal Highways Department named after Smirnov, at the Federal Road Agency” Federal Treasury Institution (“Sevzapupravtodor”).

The case was initiated upon a petition of “Russia Fuel Union” Non-Commercial Organization. According to the information available to the Antimonopoly Service, in April 2013 “Sevzapupravtodor” concluded a government contract with “Dornadzor” Ltd., which assigned to the economic entity several functions of operating management of public highways with federal status in the Leningrad, Pskov and Kaliningrad regions. In the FAS opinion, actions of “Sevzapupravtodor” can have elements of violating Part 3 Article 15 of the Federal Law “On Protection of Competition”.

Part 3 Article 15 of No.135-FZ Federal Law “On Protection of Competition “of 26th July 2006 prohibits combining the functions of federal executive bodies, the constituent territories of the Russian Federation, other government authorities, local self-government bodies and the functions of economic entities, except cases specified in the federal laws, the Orders of the President of the Russian Federation and Decrees of the Government of the Russian Federation, as well as assigning the functions of rights of the above bodies to economic entities, including the functions and rights of public oversight authorities, unless otherwise established by No. 317-FZ Federal Law “On “Rosatom” Nuclear Energy State Corporation” of 1st December 2007 and No. 238-FZ Federal Law “On State Corporation for Constructing Olympic Facilities and Developing Sochi as an Alpine Resort” of 30th October 2007.
