OREANDA-NEWS. March 27, 2014. Moscow Arbitration Court dismissed the claim of the Main Department of the Ministry of Emergencies of the Russian Federation in the Leningrad Region to invalidate FAS request to the dealers of “Argus-Spektr” CJSC in order to study the market of fire-protection equipment.

The claimants in the case were dealers of “Argus-Spektr” CJSC that received FAS requests on submitting information. Later the legal entities that received the request withdraw their claim and the case was closed. The Main Department of the Ministry of Emergencies in the Leningrad Region was brought in the proceedings as the third party, by proxy represented at Court by Deputy Director of “Argus-Spektr” CJSC, and insisted on invalidating FAS request.

The Court dismissed the claim in full.

“Article 25 of the Federal Law “On Protection of Competition” directly obligates legal entities to provide information upon a request of the antimonopoly body. Legal actions of the antimonopoly body did not infringe anyone’s rights in the field of entrepreneurial activities. In my opinion, by putting forward various absurd accusations against FAS and initiating often meaningless judicial proceedings, “Argus-Spektr” CJSC is abusing their rights. I believe that acting as a proxy of the Main Department of the Ministry of Emergencies in the Leningrad Region, this commercial organization to a considerable extent discredit a respected government body for the sake of own opportunistic interests”, pointed out the Head of FAS Anti-Cartel Department, Andrey Tenischev.
