FAS: Karelia Committee of Managing State Property Violated Law
OREANDA-NEWS. March 24, 2014. The Federal Antimonopoly Service (FAS Russia) found that the State Committee of the Republic of Karelia for Managing State Property and Procurement violated the antimonopoly law in a course of a tender (Part 1 Article 17 of the Federal Law “On Protection of Competition”).
In April 2013, the Committee organized a tender for the right to conclude a contract for leasing heating power facilities that belong to the state property of the Republic of Karelia. The tender documentation did not specify the obligation of a potential winner provided for by the Long-Term Target Programme of the Republic.
The FAS Commission concluded that the obligation of the tender winner to fulfill the Programme is an integral condition of the contract for leasing heating power facilities.
“Such actions by the Committee could have affected the bidders’ decision to take part in the tender, which shows that competition was restricted in the course of the tender”, emphasized Deputy Head of FAS Department for Control over Housing and Utilities Sector, Construction and Natural Resources, Anna Davydova.
