Kazakhstan Reduces Fines for Small Businesses
OREANDA-NEWS. February 21, 2014. A draft Code of the Republic of Kazakhstan on Administrative Violations is being considered at the plenary session of the Majilis.
Introducing the bill to the deputies, the Minister of Justice of the Republic of Kazakhstan Berik Imashev noted that sizes of a fine for small businesses has been reduced on an average 2 times in the new edition of the Code.
"As of today, small businesses have assets less than 5 times than that of medium-sized business, and the penalties of the Code are the same," B. Imashev said.
In addition, use of warnings as a type of an administrative penalty is expanded the new edition. Competence of bodies authorized to consider cases on administrative offenses is revised. In particular, 90 articles and 52 parts of the articles in the sanctions where a mulctary punishment is specified were transferred from the jurisdiction of the court to the public authorities.
In addition, the new edition provides for modernization procedures for administrative prosecution. Abbreviated proceedings on administrative offenses in cases where payment is made on receipt are being introduced which is given to a person with the protocol on administrative offense, i.e. this person agrees with the fact of committed offense, admits his guilt, ready to voluntarily pay the fine and has no claim. While a reduced order will be provided with an incentive mechanism in the form of a possibility to pay 50% of the total amount of the fine within seven days after getting the protocol. If a person does not agree with the fact of the offense, the case is considered in a general order.
