FAS Initiated Case against Argus-Spektr & its Dealers
OREANDA-NEWS. February 12, 2014. The Federal Antimonopoly Service (FAS Russia) initiated an antimonopoly case against “Argus-Spektr” CJSC and its dealers that had concluded prohibited “vertical” agreements on the market of special fire-fighting equipment supplied to the Ministry of Emergencies of the Russian Federation.
In 2013 FAS carried an unscheduled inspection of “Argus-Spektr” CJSC and suspect that the company had concluded contracts for supplying its products, indicating the lowest resale prices of the goods, which is directly prohibited by Part 2 Article 11 of the Federal Law “On Protection of Competition”.
“Prohibited vertical agreement obligate dealers to fix the lowest resale prices of the goods, which considerably restricts competition. Customers of “Argus-Spektr” CJSC also include state-run institutions, and the sales policy can do harm to the budgets of all levels. Investigating the antimonopoly case, the FAS Commission shall give legal opinion of the actions of “Argus-Spektr” CJSC and its dealers, and verify whether those actions haves signs of other violations of the antimonopoly law”, explained the Head of FAS Cartel Department, Andrey Tenischev.
