OREANDA-NEWS. January 29, 2014. Moscow Arbitration Court pronounced legitimacy of the decision of the Federal Antimonopoly Service (FAS Russia) to hold “Pharmstandart” OJSC administratively liable and fined the company over 201 million RUB.

Examining the case, the Court took into account the position of the Federal Arbitration Court of the Moscow District, that earlier dismissed the rulings of Moscow Arbitration Court and 9th Arbitration Appeal Court on the case.

On 25th May 2012, FAS found that “Rosta” CJSC and “Pharmstandart” OJSC violated Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition” by bid-rigging at competitive bidding for medicines procurement.

“FAS pays significant attention to one of the main principles of legal liability – the principle of unavoidability. Violators must be aware that their actions will inevitably be subject to penalties, the size of which exceeds manifold profit from unlawful activities”, pointed out the Head of FAS Anti-Cartel Department, Andrey Tenischev.
