ltiyskiy Zavod – Ship-Building Violates Procedures of Tender
OREANDA-NEWS. January 06, 2014. The Commission of the Federal Antimonopoly Service (FAS Russia) found that “Baltiyskiy Zavod – Ship-Building” Ltd. (“BZC” Ltd. included in the group of persons of “Integrated Ship-Building Corporation” State-Owned Company) violated the procedures for determining the winner of a tender for a contract for supplying high-resistance naval rolled steel to build LK-60 lead universal atomic ice-breaker.
Three companies were allowed to take part in the tender: “Severstal” OJSC (Cherepovets Steel Mill), “Russian Mining Company” Ltd., and “Neva-MetallTrade” Ltd., as their bids complied with the Procurement documentation.
The Procurement documentation specified two criteria to determine the winner: the contract price (90%) and experience (10%).
The FAS Commission established that “Severstal” OJSC had offered the lowest price. The company also had experience of manufacturing and supplying high-resistance naval flat steel: under the supervision of “Prometei” Central Research Institute of Construction Materials, “Severstal” manufactured high-resistance naval rolled steel, grades D500W, E500W, F500W, for building “Prirazlomnaya” platform and “Arkticheskaya” self-elevating floating drilling unit.
In spite of the conditions offered by “Severstal” OJSC, “Russian Mining Company” Ltd. was pronounced the tender winner. It offered to supply at a higher price Poland-made products, which at the time of the tender were not certified by “Russian Marine Register of Shipping”.
Thus, the bids evaluation was contrary to the procedures determined by “BZC” Ltd. in the Procurement documentation. The FAS Commission found that the company violated Clause 3 Part 1 Article 17 of the Federal Law “On Protection of Competition” in the part of breaching the procedures for determining the winner.
