Court: FAS Lawfully Fined MRSK Urals
OREANDA-NEWS. November 19, 2013. Moscow Arbitration Court pronounced legitimacy of the determination of the Federal Antimonopoly Service (FAS Russia) to hold “MRSK Urals” OJSC administratively liable for abusing market dominance (a breach of Article 14.31 of the Code of the Russian Federation on Administrative Violations).
In November 2011, the Antimonopoly Service received a petition from “Roskommunenergo” OJSC that “MRSK Urals” OJSC violated the antimonopoly law by imposing additional volumes of the announced capacity for 2012.
The FAS Commission established that the petitioner and the network organization concluded a contract for electric power transmissions services. “MRSK Urals” OJSC was insisting on prolonging the contract on the conditions which would exceed the capacity declared by “Roskommunenergo” OJSC. Such actions towards imposing additional volumes infringed the petitioner’ interests due to imposing economically and technologically unjustified obligations.
The legitimacy of FAS decision was confirmed by judicial acts that came into force. Based on this decision, the Antimonopoly Service held “MRSK Urals” OJSC administratively liable and imposed a fine – 17.9 million RUB.
The network organization filed a lawsuit but Moscow Arbitration Court found that the Antimonopoly Service had imposed the fine legitimately.
