FAS Initiated Case against Baltic Works – Shipbuilding
OREANDA-NEWS. October 07, 2013. The Federal Antimonopoly Service (FAS Russia) initiated a case against “Baltic Works – Shipbuilding” Ltd. (“BZS” Ltd.) upon signs of violating the procedures for determining the winner of an open quotation request for concluding a contract for supplying high-endurance ship rolled metal products (in breach of Clause 3 Part 1 Article 17 of the Federal Law “On Protection of Competition”).
The case was initiated upon a petition of “Severstal” OJSC about actions of “BZS” Ltd. in the course of quotation requests, and upon information obtained following FAS requests.
Analyzing the information, FAS established that in the course of quotation requests the Purchasing Commission of “BZS” Ltd. had violated the procedures for determining the winner by evaluating and comparing applications for quotation requests upon the criteria that had not been specified in the documentation. “BZS” Ltd. organized a quotation request in the form of a tender, which is a competitive bidding procedure.
