FAS Found that MRSK North-West Violated Antimonopoly Law
OREANDA-NEWS. The Federal Antimonopoly Service (FAS Russia) exposed a violation committed by “MRSK North-West” OJSC. The company was imposing disadvantageous conditions of a contract for electric power transmission services (Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”).
Earlier FAS received a petition from “Mezhregionenergosbyt” OJSC, stating that “MRSK North-West” OJSC avoided agreeing upon capacity volumes announced by the company for 2012.
As a result of the network organization refusing to apply in calculations the capacity values announced for 2012 and applying the maximum announced capacity value agreed for 2011, “Mezhregionenergosbyt” OJSC incurred losses for over 31 million Rubles.
Insisting on concluding the contract under the conditions of capacity value exceeding the value announced by “Mezhregionenergosbyt” OJSC, “MRSK North-West” OJSC is imposing disadvantageous contract conditions.
At the same time, “Mezhregionenergosbyt” OJSC is obligated to pay for capacity in accordance with the values taken into account by the Regional Economic Commission of the Vologda region regulating the tariff for 2012, which can result in infringing the rights and legitimacy interests of “Mezhregionenergosbyt” OJSC.
On 23rd May 2013, FAS issued a warning to the company to stop actions (omissions) that had signs of violating the antimonopoly law. However, “MRSK North-West” OJSC failed to execute the warning.
