FAS Warned Baxter Not to Violate Antimonopoly Law
OREANDA-NEWS. October 01, 2013. The Federal Antimonopoly Service (FAS Russia) issued a warning to “Baxter” CJSC that it must not refuse to supply a medicine for treatment of renal failure by peritoneal dialysis that does not have any analogues.
The FAS reaction was caused by “Baxter” CJSC refusing to supply “Extranil” (International Non-Proprietary Name – Icodextrin) to “Medical Service Company” Ltd. which provides an integrated medical service for organizing the procedures of out-patient peritoneal dialysis in the Samara region.
FAS analysis showed that the procedures used by “Baxter” CJSC to select counteragents did not have clear criteria for selecting and approving counteragents as well as the deadlines and the procedures for considering offers, the procedures and conditions of work and terminating contractual relations.
Deputy Head of FAS Department for Control over Social Sphere and Trade, Natalia Sharavskaya commented the decision of the antimonopoly body: “Economically and technologically unjustified refusal of “Baxter” CJSC to supply the medicine has signs of violating Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Comepition” restricting competition and infringing the interests of other persons. The violation leads to competition restriction and infringing the interests of “Medical Service Company” Ltd.”
