OREANDA-NEWS.  August 23, 2013. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Health Care of the Russian Federation for violating Part 1 Article 15 of the Federal Law “On Protection of Competition”.

The Ministry restricted goods buyers in their choice of economic entities supplying such goods, created discriminatory conditions as a result of not considering petitions, and not including insulin glulisine (tradename – “Apidra”) in the “List of drugs, including a list of medical drugs prescribed by medical panels of medical and preventive treatment institutions, that are supplied in accordance with the medical aid standards on doctor’s (paramedic’s) prescription when rendering state social support in the form of social service package”, approved by an order of the Ministry of Health Care and Social Development.

“The Federal Law “On State Social Support” provides for supplying the necessary drugs to the persons that enjoy federal benefits, including the disabled. Such drugs are supplied only in accordance with the above list, so not including a particular drug in it means that the state does not purchase it and access of medical institutions and, as a consequence, patients to it is restricted”, explained Deputy Head of FAS Department for Control over Social Sphere and Trade, Nadezhda Sharavskaya.
