OREANDA-NEWS. August 08, 2013. The Federal Antimonopoly Service (FAS Russia) terminated the proceedings against the Regional Office of Rosimuschestvo (the Federal Agency for State Property Management) in the Kamchatka region (Kamchatka Regional Office of Rosimuschestvo).

The case was initiated upon signs of violating the Federal Law “On Protection of Competition” (Article 15): omissions by Kamchatka Regional Office of Rosimuschestvothat did not place a government order for concluding contracts for storage of confiscated sea vessels.

Investigating the case, the FAS Commission found that for several years the economic entity stored confiscated vessels on the basis of a government contract, validity period of which had expired long ago. Kamchatka Regional Office of Rosimuschestvo did not have a possibility to place state procurement order due to absence of budget limits. Rosimuschestvo and its regional office repeatedly attempted to resolve the situation; so far, however, the issues of storing, utilizing or selling confiscated vessels have not been regulated by law.

Based on the obtained information, the FAS Commission decided to terminate the case.

“Absence of normative-legal regulation in the field of storage, sale and utilization of confiscated sea vessels, in particular, absence of utilization procedures impose enormous additional burden upon the federal budget. FAS will present its position to the Ministry of Economic Development and will forward the relevant materials to financial controlling bodies”, pointed out the Head of FAS Department for Control over the Authorities, Vladimir Mihselovin.
