Court: Komi OFAS Lawfully Fined MRSK North-West
OREANDA-NEWS. August 02, 2013. The 2nd Arbitration Appeal Court (Kirov) pronounced legitimacy of the decision issued by the Office of the Federal Antimonopoly Service in the Komi Republic (Komi OFAS Russia) that “MRSK North-West” OJSC abused its market dominance: the company was delaying technological connection of a residential house to electric power networks.
Komi OFAS Russia initiated a case upon a petition from a resident who concluded a contract with “MRSK” in March 2011 and the works had to be completed within six months. However, the technological connection took place only in February 2012 after the petitioner complained to the antimonopoly body.
On 22nd May 2012, the Commission of Komi OFAS Russia found that “MRSK North-West” OJSC violated Article 10 of the Federal Law “On Protection of Competition” and imposed a turnover fine - 58 million Rubles.
The monopolist disagreed with the decision made by the Antimonopoly Service and filed a lawsuit. However, the Court of First Instance and the 2nd Arbitration Appeal Court dismissed the claim.
“The problem of violating the Rules for technological connection to electric power networks affects both residents and business. Timely connection to electric power networks is an important factor of social and economic development. Therefore, control over technological connection is a priority for the Antimonopoly Service”, commented Acting Head of Komi OFAS Russia, Tatiana Mikhailova.
