FTS Prevented Competition on Electric Power Market in Volgograd Region
OREANDA-NEWS. July 22, 2013. Moscow Arbitration Court upheld the decision of the Federal Antimonopoly Service (FAS Russia) that the Federal Tariff Service violated the Federal Law “On Protection of Competition” (Part 1 Article 15).
FAS received a petition from “Volgogradoblelektrosbyt” (“VOES” Ltd.) about signs of violating the antimonopoly law by the Federal Tariff Service that had omitted to include “VOES” Ltd. in the list of buyers in the Consolidated Pro Forma Balance Sheet 2011 for generating and supplying electric power within the Unified Energy System of Russia in the Volgograd region (Consolidated Pro Forma Balance Sheet).
Failure to include “VOES” Ltd. in the Consolidated Pro Forma Balance Sheet 2011 prevented its activities on the wholesale market of electric power (capacity).
Actions of the Federal Tariff Service could have created the grounds for depriving “VOES” Ltd. of the right to take part in trading electric power (capacity) as well as of the status of provider of last resort.
The Federal Tariff Service disagreed with the FAS decision and filed a lawsuit to Moscow Arbitration Court requesting to invalidate it. The Court, however, dismissed the claim and upheld FAS decision.
