Nizhniy Novgorod Airports Unlawfully Charged for Transport Tracking
OREANDA-NEWS. June 10, 2013. The Office of the Federal Antimonopoly Service in the Nizhniy Novgorod Region (Nizhniy Novgorod OFAS Russia) found that “Nizhniy Novgorod International Airport” OJSC abused market dominance (Part 1 Article 10 of the Federal Law “On Protection of Competition”).
The case was initiated on 2nd April 2013 upon a complaint from an economic entity involved in commercial activities in the airport. The complaint stated that the airport had been unlawfully charging for the mandatory services of vehicle tracking within the airport and for issuing permits to enter the terminal control area.
Investigating the case, the Commission of Nizhniy Novgorod OFAS Russia established that “Nizhniy Novgorod International Airport” OJSC was unlawfully charging for transport tracking within the airport - 5500 Rubles per vehicle.
The Commission concluded that such measures for control over transport movements within the airport were part of ensuring internal security policy in the airport and maintaining aviation security in general. Under the current law, only air carriers can be charged for providing aviation security in the terminal control area, while third-party contractors cannot be charged.
Upon completing the investigation, OFAS issued a determination to “Nizhniy Novgorod International Airport” OJSC to stop violating the antimonopoly law.
“OFAS will open administrative proceedings against the violators for abusing market dominance”, pointed out the Head of Nizhniy Novgorod OFAS Russia, Mikhail Teodorovich.
