OREANDA-NEWS. June 03, 2013. The Federal Antimonopoly Service (FAS Russia) initiated an antimonopoly case against the Government of the Republic of Sakha (Yakutia), the Ministry of Health Care of the Republic of Sakha (Yakutia).

“No.2 Republican Hospital – the Centre of Emergency Medical Care” State Budgetary Institution of the Republic of Sakha (Yakutia), “DIATECH AG” CJSC, “Diatech S.А.” (Switzerland), “ROST MED” Ltd., a group of persons including “Siemens Aktiengesellshaft” (Germany) and “Siemens” Ltd.

The case was initiated upon materials received by the Antimonopoly Service from the Investigation Department of the Republic of Sakha (Yakutia), the Investigation Committee of the Russia. Having examined the obtained documents, FAS identified signs of violating the Federal Law “On Protection of Competition”. The authorities and economic entities – members of the group of “Siemens AG” concluded an anticompetitive agreement for procurement of medical equipment for the needs of the Republic of Sakha (Yakutia).

“This is the first case in FAS practice when the bid-rigging case is initiated against economic entities registered and located outside the Russian Federation. The norms of the Federal Law “On Protection of Competition” are applied to the agreements between Russian and foreign organizations if such agreements affect the state of competition in Russia”, commented Deputy Head of FAS Anti-Cartel Department, Andrey Tenischev.
