OREANDA-NEWS. May 30, 2013. The Government has approved a new order of employment of foreigners and stateless persons, which envisages protection of Ukrainian employment market from non-qualified workforce, and also reduced the number of necessary permissions.

A respective decision was adopted recently by the Cabinet of Ministers, deputy head of the Department of labour and employment of the Ministry of Social Policy of Ukraine Oleh Prutenko said.

Oleh Prutenko noted that a CMU resolution titled “Issuing, extension and revocation of the permission on employment of foreigners and stateless persons” had been approved on implementation of the Law “On the employment of population” acting in Ukraine from January of the current year.

He informed that as use of labour of foreigners in Ukraine created competition to the Ukraine’s nationals, it was envisaged that issuing of such permission was paid and made up 4 minimal wages (from January 1 of the current year a minimal wage is UAH 1147).

“These funds are transferred by an employer to the Fund of obligatory state social insurance of Ukraine in case of unemployment. They are used to stimulate creating of new workplaces, payment of unemployment assistance and other measures joined with employment of citizens of Ukraine,” he explained. 

Besides, according to Oleh Prutenko, in order to protect the labour market from non-qualified workforce it is envisaged that such permission will be given to employers on condition of absence of unemployed of respective qualification in the employment service’s register. 

“As compared to the previous order issuing of such permission has been simplified. In particular, the number of documents handed over by the employee has been shortened from 15 to 8, the term of considering the documents by the State Employment Service has been cut from 30 to 15 days. At the same time, the term of validity of such permission remained unchanged – up to 1 year,” he said.

Such permission is not needed for employment of foreigners who constantly reside in Ukraine. Besides, it is not needed also for foreign media representatives, sportsmen, actors and artists, employees of rescue services, employees of foreign representatives, foreigners who came to Ukraine to participate in implementation of projects of international technical assistance and performing education activities in the specialty in the state higher educational institutions.
