OREANDA-NEWS. May 28, 2013. Dagestan Arbitration Court pronounced legitimacy of the decision of the Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan OFAS Russia) regarding “Dagestan Energy Supplier” OJSC (“DESK”).

Earlier Dagestan OFAS Russia found that “DESK” OJSC violated the antimonopoly law presenting “Makhachkala City Electric Networks” OJSC and “Derbentvodokanal” Unitary Municipal Enterprise with bills for payments for consumed electric power (Clause 10 Part 1 Article 10 of the Federal Law “On Protection of Competition”).

“DESK” OJSC disagreed with the decision of the antimonopoly body and filed a lawsuit to Dagestan Arbitration Court, which dismissed the company’s claim.

“Actions of “DESK” OJSC had negative impact upon competitive environment through violating the pricing procedures for electric power (capacity) established by regulatory acts. Therefore, the decision of Dagestan Arbitration Court justly confirms legitimacy of the actions of Dagestan OFAS Russia”, the Head of OFAS Kurban Kubasaev commented the situation.
