FAS: Restricting Sales of Alcohol in Foodservice Outlets Unlawful
OREANDA-NEWS. May 24, 2013. The Federal Antimonopoly Service (FAS Russia) investigated a case against the Government of the Stavropol Region upon signs of violating the Federal Law “On Protection of Competition” (Article 15) and the Federal Law “On Regulating Trading Activities” (Article 15).
The Government of the Stavropol Region passed a Decree to ban retail sales of alcohol products in foodservice outlets located in cultural organizations and in recreational areas (in parks, public gardens, beaches) from 15th June 2012.
Under the federal laws, restrictions of retail sales of alcohol products do not cover retail sales in foodservice outlets.
In the course of the investigation, the Government of the Stavropol Region accepted committing the violation and notified FAS that the Decree had been abolished.
“The national policy towards reducing consumption of alcoholic beverages is exercised under the framework of the relevant concept and the current federal law. FAS will continue suppressing all actions of the authorities at the level of the constituent territories of the Russian Federation that do not comply with the federal laws and result in unreasonable restrictions of competition”, pointed out Deputy Head of FAS Pavel Subbotin.
