RZD Discriminated Petrotrans-Petromorsk in Access to Infrastructure
OREANDA-NEWS. May 07, 2013. The Commission of the Federal Antimonopoly Service in the Leningrad region (Leningrad OFAS Russia) found that “Russian Railways” OJSC violated the Federal Law “On Protection of Competition” in the part of creating discriminatory conditions.
The case against “Russian Railways” OJSC was initiated upon a petition of “Petrotrans-Petromorsk” Ltd. According to the petition, the technical conditions for general use, issued by “Russian Railways” OJSC to “Petrotrans-Petromorsk” Ltd. include considerable number of works for developing rail tracks in general use, which is not provided for by the current law and was proved by the antimonopoly body in 2012 and judicial proceedings throughout 2013.
The Commission of Leningrad OFAS Russia established that the technical conditions issued by “Russian Railways” OJSC to “Petrotrans-Petromorsk” Ltd. contained considerably more requirements for the works for developing the railway infrastructure in general use than the technical conditions issued to “Sibur-Portenergo” Ltd. and “Novatek Ust-Luga” Ltd., operating in Ust-Luga port, which put the companies in unequal positions. In the near future, OFAS will issue a determination to “Russian Railways” OJSC to stop violating the antimonopoly law.
“Creating discriminatory conditions for some economic entities with regard to others is one of the prohibited activities for the operators, dominating the market. It is a serious violation of Article 10 of the Federal Law “On Protection of Competition””, emphasized the Head of Leningrad OFAS Russia, Vadim Vladimirov.
