OREANDA-NEWS. April 29, 2013. The 11th Arbitration Appeal Court (Samara) pronounced legitimacy of the decision and determination of the Office of the Federal Antimonopoly Service in the Ulyanovsk region (Ulyanovsk OFAS Russia) regarding “Volzhskaya TGK” OJSC.

In September 2012, the Commission of Ulyanovsk OFAS Russia found that “Volzhskaya TGK” OJSC abused market dominance (in breach of Article 10 of the Federal Law “On Protection of Competition”). In 2012 the company charged “Sodruzhestvo” STs VES” Ltd. for the heating energy, the volume of which was determined applying a coefficient, that was not supposed to be used.

Having investigated the case, Ulyanovsk OFAS Russia fined the company over 940,000 Rubles.

“Volzhskaya TGK” OJSC disagreed with the actions of the antimonopoly body and filed a lawsuit. The 11th Arbitration Appeal Court, however, dismissed the claim.

In particular, “Teploservice” Ulyanovsk Municipal Unitary Enterprise stopped committing violations and paid 11 million Rubles AS A FINE. Now it’s the turn of “Volzhskaya TGK” OJSC”, pointed out the Head of Ulyanovsk OFAS Russia, Gennady Spirchagov.
