OREANDA-NEWS. April 26, 2013. “Russian Railways” OJSC executed a warning of the Federal Antimonopoly Service (FAS Russia).

Earlier, “Russian Railways” OJSC issued and applied the telegram instructions of Acting General Director of the Premium Service Centre, Mr Kolesnikov, of 19th March 2013 (No.TsFTOMiR-6/4), that set restrictions with regard to thr dates, the volume of freight, and approval of applications for freight by rail transport in general use.

The telegram of “Russian Railways” OJSC determined the procedures for approving freight applications (form GU-12), accepting loaded cars for transportation, that were different from the current law, in particular, the Railway Statute, and the Rules for Accepting Freight Applications by Rail.

Governed by Article 39.1 of the Federal Law “On Protection of Competition”, FAS warned “Russian Railways” OJSC to stop violating the antimonopoly law (Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”) by abolishing the telegram instructions of Acting General Director of the Premium Service Centre, Mr Kolesnikov, of 19th March 2013 (No.TsFTOMiR-6/4) and to approve freight applications by rail transport in general use within the deadlines and under the procedures established by the federal laws and other regulations.

Earlier FAS warned “Russian Railways” OJSC to abolish the telegram, since the company had introduced similar restrictions by No.16676 telegram of 5th October 2012, which “Russian Railways” OJSC had abolished on 14th January 2013.
