OREANDA-NEWS. April 09, 2013. The Federal Arbitration Court of the Urals District pronounced legitimacy of the decision made by the Office of the Federal Antimonopoly Service in the Orenburg region (Orenburg OFAS Russia) regarding “Orenburgenergoneft” OJSC.

In December 2011, Orenburg OFAS Russia received a complaint from a physical person about actions of “Orenburgenergoneft” OJSC.

The Commission of Orenburg OFAS Russia established that “Orenburgenergoneft” OJSC had refused to agree upon an application for technological connection of a land plot to electricity networks in breach of Article 10 of the Federal Law “On Protection of Competition”.

Having investigated the case, the antimonopoly body fined “Orenburgenergoneft” OJSC over 11 million Rubles. The company failed to pay the fine within the designated period and Orenburg OFAS Russia imposed another fine for the amount of 150,000 Rubles.

The company disagreed with the decision and filed a lawsuit. Courts of three instances, however, supported the position of Orenburg OFAS Russia.

“The fact that we won cases of such scale as the case on “Orenburgenergoneft” OJSC is important because companies rendering similar services learn to lawfully operate on a particular market through such “sad” experience of their “colleagues””, commented Deputy Head of Orenburg OFAS Russia, Alexander Shlychkov.
