OREANDA-NEWS. April 03, 2013. The Office of the Federal Antimonopoly Service in the Leningrad Region (Leningrad OFAS Russia) found that “Lenenergo” OJSC abused its market dominance (Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”).

Leningrad OFAS Russia received a complaint from a resident of the Leningrad region that the network organization had issued a contract and technical conditions for connecting a residential house, which included conditions contradicting the current law.

OFAS sent a warning to the network organization to stop abusing market dominance. “Lenenergo” OJSC amended only four out of the six unlawful requirements that were in breach of the rules for technological connection and maintained two unlawful conditions.

Investigating the case, the Commission revealed that “Lenenergo” OJSC included additional requirements in the latest edition of the technical conditions that had not been put in earlier to the petitioner and are not provided for by the current law. This circumstance additionally confirmed that the network organization abused its rights and that fact of insisting that the petitioner should comply with the conditions not provided for by the law confirms the violation.

OFAS will issue a mandatory determination to the network organization to eliminate the violation.

“The decision is aimed at protecting the rights and legitimate interests of citizens. We expect that “Lenenergo” OJSC will timely execute it”, commented Deputy Head of Leningrad OFAS Russia, Gleb Konnov.
