Voronezh OFAS Exposed Bid-Rigging Cartel at Electronic Auction
OREANDA-NEWS. March 21, 2013. Voronezh Office of the Federal Antimonopoly Service (Voronezh OFAS Russia) exposed a violation of the antimonopoly law in the actions of “Lipetskregion” Ltd., “Aliiance-Agro” Ltd., and an individual entrepreneur Gotsak in the course of an electronic auction for supplying bakery products and pastry for MBDOU of the Lenin District in the first six months 2013 (Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”).
In the course of the electronic auction “Aliiance-Agro” Ltd. filed a price bid different from the initial contract price. Then within a short time interval only two procurement participants filed their price bids – “Lipetskregion” Ltd. and an individual entrepreneur Gotsak, as a result of which the contract price was decreased by 58.1% (by 420.000 Rubles), after which the auction was completed.
Upon considering the second part of the bids, the bids from “Lipetskregion” Ltd. and an individual entrepreneur Gotsak were rejected because those persons were included in the Register of Unfair Suppliers. The contract was concluded with “Aliiance-Agro” Ltd. It was also revealed that Mr. Gotsak is the only founder of “Lipetskregion” Ltd., which indicates that he was not intended to conclude the contract.
Currently OFAS is looking into the issue of holding the violators administratively liable.
“Along with improving the law, unlawful methods of obtaining budgetary funds are also being ungraded. However, our specialists have sufficient professionalism and qualification to suppress violations and punish the violators”, pointed out the Head of Voronezh OFAS Russia Vladimir Rokhmistrov.
