OREANDA-NEWS. February 14, 2013. Ulyanovsk Regional Arbitration Court upheld the decision and determination of the Office of the Federal Antimonopoly Service in the Ulyanovsk Region (Ulyanovsk OFAS Russia) regarding “Volzhsk TGK” OJSC, reported the press-centre of FAS Russia.      

Earlier, on 21st September 2012 the Commission of Ulyanovsk OFAS Russia found that “Volzhsk TGK” OJSC abused its dominance (Part 1 Article 10 of the Federal Law “On Protection of Competition”). In 2012 the company charged “Sodruzhestvo” STs VES” Ltd. for the heat energy, the volume of which was determined using a coefficient that must not had been applied.

Having investigated the case, Ulyanovsk OFAS Russia fined the company over 940,000 Rubles.

“Volzhsk TGK” OJSC disagreed with the OFAS decision and filed a lawsuit to Ulyanovsk Regional Arbitration Court, which, however, supported the position taken by the antimonopoly body.

The Head of Ulyanovsk OFAS Russia, Gennady Spirichagov, emphasized importance of the fact that “even before the problems in the housing-and-utilities sector aggravated this winter, OFAS experts had exposed several violations committed by heat-power engineering enterprises. In particular, “Teploservice” Ulyanovsk Municipal Unitary Enterprise stopped the violations and paid 11 million Rubles as a fine. Now it’s the turn of “Volzhsk TGK” OJSC”.

Previously Ulyanovsk OFAS Russia had already fined “Volzhsk TGK” OJSC 8.29 million Rubles.
