OREANDA-NEWS. January 09, 2013. A new system of state registration of the immovable property rights and their encumbrances has been launched the creation of which is envisaged by the Law of Ukraine “On the state registration of immovable property rights and their encumbrances”. This was informed by the head of the State Registration Service Leonid Yefymenko in the course of a briefing at the Cabinet of Ministers.

“As of January 2 all normative-legal acts directed to realization of the Law of Ukraine “On the state registration of immovable property rights and their encumbrances” have been approved – 5 laws, 6 resolutions of the Cabinet of Ministers of Ukraine, 15 acts of the Justice Ministry of Ukraine and 7 methodical recommendations,” informed the head of the State Registration Service.

According to Leonid Yefymenko, the State Registration Service has created an institutional system of the state registration of immovable property rights which comprises 583 bodies of state registration of rights with 2646 state registration specialists.

Besides, the new legislation imposes functions of state registration specialists on 6835 notary officers as special subjects.

The head of the State Registration Service informed that the state registration of rights is held by the state registration specialists in the following cases:

-       the law envisages the state registration of rights with issuing of a certificate on immovable property right, in particular, on newly-erected objects, reconstructed immovable property objects, objects included into the statutory fund, that is “primary” registration;

-       state registration of rights on the basis of decisions of administration bodies, in particular on the basis of decisions of court, prosecutor’s office, tax bodies, local self-government bodies;

-       state registration of rights that appeared before January 1, 2013 and were not registered in compliance with the legislation in action at that period.

Legislative and technical conditions to fill the State Register of immovable property rights from the following registers have been created: Register of immovable property rights, Single register of immovable property alienation, State register of mortgages and State register of encumbrances of movable property.

The head of the State Registration Service of Ukraine also noted that last year pilot exploitation of information interaction was completed by the administrator of the State land cadastre and State register of immovable property rights.
