Court: Suspended Telecommunication Cables Cannot Be Prohibited
OREANDA-NEWS. December 12, 2012. Moscow Arbitration Court pronounced legitimacy of the decision and determination of the Federal Antimonopoly Service (FAS Russia) regarding Yekaterinburg City Authority, reported the press-centre of FAS Russia.
On 30th May 2012, FAS found that Yekaterinburg City Authority violated Clauses 1 and 2 Part 1 Article 15 of the Federal Law “On Protection of Competition”. Yekaterinburg City Authority breached the law by passing the Resolution “On Restricting Arrangements of Fibro - Optic Lines on Outdoor Lighting Poles and within Contact Network in the “Yekaterinburg City” Municipality” of 16th September 2011. The Resolution restricted possibilities of using contact network poles for arranging telecommunication cables and created unreasonable requirements to providers placing telecommunications cables.
Upon establishing the fact of the violation, FAS issued a determination to Yekaterinburg City Authority to eliminate violations of the antimonopoly law by making changes to the Resolution.
