Legal Aspects of Biofuel Production Discussed on Graintech-2012
OREANDA-NEWS. December 04, 2012. At the round-table Ekaterina Baryshnikova, Deputy Director General of NP “Center of Innovations”, andYury Alyakrinsky, Chief Engineer on Bioethanol of “Titan-Agro” Ltd. discussed proposals on alterations in legislation and normative acts for exemption of denatured fuel bioethanol from excises, reported the press-centre of Titan.
Current version of federal legislation “On State Regulation of Production and Turnover of Ethyl Alcohol, Spirituous and Alcohol-Containing Products” (from 22 November 1995 Nr 171-FZ) restraints possibilities of development of biofuel turnover, as it provides strict requirements and limitations for production and turnover of fuel ethanol. According to the law fuel bioethanol belongs to denatured spirituous production, which is also subjected to excise. Nowadays it is economically unprofitable for national producers to produce fuel bioethanol in industrial scale. For that reason one of the projects of petrochemical cluster of the project “PARK” – production of ethyl tertiary-butyl ether – was not completely finished. ETBE is oxygenated additive for fuels based on bioethanol. Now the unit produces methyl tertiary-butyl ether.
As the outcome of the working session a number of legislative and legal recommendations on stimulating of production of liquid biofuel in Russian Federation were elaborated and supported, in particular:
define the notion of denatured fuel bioethanol as ethyl alcohol, meant for production of motor biofuels or fuel additives and components, used in internal combustion engines;
define the notion of fuel biocomponents as components (additives) of motor fuel, produced on the basis or with the usage of fuel bioethanol;
define that fuel bioethanol and fuel biocomponents are not subjected to state regulation as alcohol-containing production;
establish the fact that fuel bioethanol and fuel biocomponents are not subject to excise;
toughen the sequence of denaturation of technical alcohol, which will provide impossibility of its use as food;
elaborate the issue of lowering of rate of excise on motor fuel, which contains bioethanol as impurity, and also fuel components, produced on the basis of fuel bioethanol.
Not only specialists from producers and representatives of business, but also representatives of authorities, science and Russian technological platforms participated in the round-table negotiations.
As a consequence of the discussion it was decided to improve the proposals before November 30, 2012 and to present them by way of technological platform “Bioenergy” to the Ministry of Economic Development, Ministry of Finance, State Duma (working group on realization of complex program Biotech-2020), and also to “Rosalcohol”.
