OREANDA-NEWS. November 15, 2012. The Federal Arbitration Court of the North-Western District considered a complaint of “Kaliningradgazifikatsiya” OJSC against the Office of the Federal Antimonopoly Service in the Kaliningrad region (Kaliningrad OFAS Russia). The Court pronounced legitimacy of the rulings passed by Kaliningrad Regional Arbitration Court and the 13th Arbitration Appeal Court, reported the press-centre of FAS Russia.

In December 2011, the Commission of Kaliningrad OFAS Russia investigated complaints from residents of the region about unreasonably high prices fixed by “Kaliningradgazifikatsiya” OJSC for assembling metering devices. The company has the dominant position on the regional market for installing gas meters. The antimonopoly body found that “Kaliningradgazifikatsiya” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance) and impose the administrative fine – 1,236,885 Rubles.

“Kaliningradgazifikatsiya” OJSC filed a lawsuit against Kaliningrad OFAS Russia to Kaliningrad Regional Arbitration Court, which fully supported the antimonopoly body. Then the company lodged an appeal to the 13th Arbitration Appeal Court, which also confirmed legitimacy of the decision passed by OFAS. “Kaliningradgazifikatsiya” OJSC attempted to challenge the position of the Appeal Court at the Federal Arbitration Court of the North-Western District; however, the Cassation Court found that the rulings of the Courts of lower instances complied with the current law.
