OREANDA-NEWS. November 09, 2012. Moscow Arbitration Court dismissed the claim of “GAZPROM” OJSC to invalidate the decision and determination of the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia. 

On 9th June 2012, FAS found that “GAZPROM” OJSC violated Clause 1 Part 1 Article 10 of the Federal Law “On Protection of Competition”. The company fixed monopolistically high price for liquid sulfur.

“GAZPROM” OJSC attempted to challenge the decision but Moscow Arbitration Court supported the FAS position.

“This case is very important for FAS because formula pricing is one of the ways for building-up a pricing strategy by companies on specific markets. However, such pricing much reflect the actual tendencies in the market rather than contradict them”, emphasized Deputy Head of FAS Russia, Andrey Tsyganov.

Later, on 1st November 2012 FAS fined “GAZPROM” OJSC 17.5 million Rubles for committing the violation on the market of liquid sulfur.

“The main sulfur consumers are producers of mineral fertilizers, which shows high social importance of the goods”, pointed out Andrey Tsyganov.
