OREANDA-NEWS. October 25, 2012. Kaliningrad Regional Arbitration Court pronounced legitimacy of the actions of the Office of the Federal Antimonopoly Service in the Kaliningrad region (Kaliningrad OFAS Russia) regarding “Chistota” Chernyakhovsky Inter-Municipal Limited Liability Company (“Chistota” MLLC), reported the press-centre of FAS Russia.

In May 2012, Kaliningrad OFAS Russia verified complaints received by OFAS that “Chistota” MLLC had increased the costs of household waste disposal. OFAS established that the company operated without a license.

Also, the company fixed the costs of solid household waste disposal on a site near Chernyakhivsky without reaching an agreement with Kaliningrad Regional Tariff Service, which contradicted the established pricing procedures.

“Chistota” MLLC has a dominant position on the market of services for consumer waste disposal within the geographic boundaries of Chenyakhvsky Municipal District - 100% share of the volume of services.

The Commission of Kaliningrad OFAS Russia found “Chistota” MLLC violated Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance) and imposed a fine in the size of the income obtained as a result of violating the antimonopoly law (578,550 Rubles).

The company disagreed with the decision of the antimonopoly body and filed a lawsuit to Kaliningrad Regional Arbitration Court.

The Court dismissed the claim of “Chistota” MLLC and obligated the company to execute the determination of Kaliningrad OFAS Russia and pay the fine imposed by OFAS.
