FAS Determines Unjustified Prices for Credit Organizations
OREANDA-NEWS. October 19, 2012. The Federal Antimonopoly Service (FAS Russia) approved the Method for determining unreasonably high and low prices for services of credit organizations, reported the press-centre of FAS Russia.
The Method is drafted to enforce the Federal Law “On Protection of Competition” (Clause 2 Part 2 Article 23).
The Method determined specifics of determining unreasonably high and low prices for services of credit organizations and shall be used in the following cases:
1. Investigating cases upon signs of violating Article 10 of the Federal Law “On Protection of Competition” in the part of establishing that a credit organization (several credit organizations – members of the same group of persons), which has dominant position, fixed unreasonably high or low prices for their services;
2. Carrying out surveys and monitoring of markets, in particular, in order to devise recommendations towards preventing violations of the antimonopoly law in the form of fixing and maintaining unreasonably high and low prices for the services of credit organizations;
3. Exposing competition-restricting agreements and concerted actions of credit organizations.
The FAS Order of 24th August 2012 comes into force ten days after its official publishing.
Note:
The dominant position of a credit organization shall be recognized in accordance with No.409 Decree of the Government of the Russian Federation “On Approving the Conditions for Recognizing Dominant Position of a Credit Organization and the Rules for Establishing the Dominant Position of a Credit Organization” and No.433 FAS Order “On Approving the Procedures for Analysis of the State of Competition in Order to Establish the Dominant Position of a Credit Organization”.
