Moldova Passed Law on Monitoring of Realty in First Reading
OREANDA-NEWS. October 16, 2012. The document is aimed at constant updating of the information about real estate facilities, its owners and nay changes in the cadastre data. This will allow having the reliable information about immobile property and the better quality of the cadastre data and the monitoring will lead to the broader taxable basis and greater receipts to local budgets.
The information is to be updated in case of any changes in the cadastre data at the application of owners or their representatives or at the request of authorized public authorities. Inline with the document, local public authorities will be responsible for presenting information to territorial cadastre bodies about changes of a form, a space floor, a purpose of land lots, buildings, premises, about issuing construction and demolition certificates , about leasing of residential spaces or other facilities of public property, about eradicating or planting perennials, about 50% and more completed constructions which have stayed incomplete for more than 3 years since the beginning of their building.
In line with the law of monitoring, possessors of the right on the real estate must ensure all information to be registered correctly. They must inform territorial cadastre offices about any changes in cadastre data within 3 months since building works’ putting into operation and resulting in alteration in the construction, flat or premises. This is true for owners of 50% - and more completed constructions if the building was started over 3 years ago and for owners reconstructing buildings and premises.
The information is to be registered in the cadastre within 3 months since the moment of drawing a justifying document, including leasing and rent contracts concluded for over 3 years. In line with the procedure of the updating, till June, 1 local authorities have to present copies of documents justifying changes in the cadastre data to territorial cadastre units. To collect as full as possible information facilities changed are to be inspected by cadastre workers.
Within 6 months since the law comes into effect , non- registered possessors of real estate have to submit documents justifying their right on the property to territorial cadastre units. After the 6 months expire, a value of the real estate will be appraised as a similar facility.
