FAS Helps Businesses Assert their Rights
OREANDA-NEWS. October 05, 2012. The Federal Antimonopoly Service (FAS Russia) took part as a third person in a hearing at Tula Regional Arbitration Court over a suit of “Mosselprom” CJSC for compensating damages inflicted by unlawful actions of the Ministry of Agriculture of the Tula Region, reported the press-centre of FAS Russia.
Earlier FAS found that the Ministry of Agriculture of the Tula Region violated Part 1 Article 15 of the Federal Law “On Protection of Competition”. The Ministry refused to grant subsidies to “Mosselprom” CJSC to compensate the costs of poultry meat production in the Tula region in QI 2011.
Tula Regional Arbitration Court examined the case materials, including FAS decision, and ruled to compensate losses to the company for over 42 million Rubles.
“This precedent is very important for establishing judicial practice of private actions that use decisions of antimonopoly bodies on violating the antimonopoly law”, pointed out the Head of FAS Department for Control over the Authorities, Vladimir Mishelovin.
