OREANDA-NEWS. October 04, 2012. The Federal Antimonopoly Service (FAS Russia) was informed that “Okhrana” Federal State Unitary Enterprise of the Russia’s Ministry of Interior paid a fine over 21 million Rubles to the federal budget, reported the press-centre of FAS Russia.   

FAS fined “Okhrana” for violating the antimonopoly law (Article 16 of the Federal Law “On Protection of Competition”): the Centre of Operational Management of Extra-Departmental Security Service of the Ministry of Interior and “Okhrana” together issued instructions, executing which inter-branch commissions required to present permission certificates for carry out the works for designing and assembling technical security equipment, issued by self-regulated organizations.

“Okhrana” Federal State Unitary Enterprise filed a lawsuit challenging FAS decision and determination on imposing the fine.

Moscow Arbitration Court and the 9th Arbitration Appeal Court supported the position of the antimonopoly authority to impose the administrative fine upon the Centre of Operational Management of Extra-Departmental Security Service and “Okhrana” Federal State Unitary Enterprise that restricted competition by issuing joint instructions that resulted or could have resulted in eliminating and (or) restricting access to the market of designing and assembling technical security equipment as well as creating advantages to particular economic entities.

“Turnover fines is an administrative sanction for organizations that violated the antimonopoly law regardless of the form of property – private or state (municipal)”, pointed out the Head of FAS Department for Control over the Authorities, Vladimir Mishelovin.
