OREANDA-NEWS. October 01, 2012. The First Arbitration Appeal Court supported the decision and determination of the Office of the Federal Antimonopoly Service in the Nizhny Novgorod Region (Nizhny Novgorod OFAS Russia) regarding the “Federal Passenger Company” OJSC and the judgment of Nizhny Novgorod Regional Arbitration Court, reported the press-centre of FAS Russia.

On 9th September 2011, the Commission of Nizhny Novgorod OFAS Russia found that the “Federal Passenger Company” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition”.

The company violated the law by preventing entrepreneurial activities, in particular, refusing to include freight cars in No.922 Kirov – Vorkuta train. Such actions created discriminatory conditions for some consignors.

Nizhny Novgorod OFAS Russia imposed an administrative fine upon the “Federal Passenger Company” OJSC (192,000 Rubles). OFAS also issued a determination to the “Federal Passenger Company” OJSC to stop abusing its dominant position and exercise actions towards protecting competition.

“We are pleased that the First Arbitration Appeal Court supported our opinion on the issue. This is a backbone ruling because to a significant degree it will determine the market behavior in the future”, pointed out the Head of Nizhny Novgorod OFAS Russia, Mikhail Teodorovich.
